Eminent Domain

Don't know about you guys...But I have been watching what's been happening with this on the news for some time...I'd like to hear what you guys think...

I was very please to at least see our goverment trying to undo the Supreme Courts decision on this...This has actually got Mike and I thinking about just renting from now on..This also happened to a dear freind of mine...She lived in her parents house (Both deceased) The house had been in her family for a long time so yeah...memories were attached to it...And then they came...Said going to build a retirement community condo place...more people to pay more taxes...going to give her fair market value of her home...they said she had no choice in the matter...it was a done deal..."Excuse me?"

Fair market value...Didn't include all the memories that went with it...She still had the carving in the wall she made as a child...Still put her Christmas tree up in the bay window in the living room just like her mom and dad did...Lit the fireplace too...That house contained so much and she loved it....It was one of those wonderful old Victorian homes that you just want to put on a Card...Warm and Inviting...Sat on 5 acres out in the boonies south of Medina in Ohio...Now it's not there...She cried the day they tore it down....She had no choice...I cannot imagine how she felt, I don't want too...

My ex Mother in law has the same kind of house...They came to her and her husband once about using the property but they quickly realized they would have to also move and entire cemetary...Abe was totally against it anyway...said he'd stand his ground against the goverment if he had too...they weren't taking his home...He bought the house for $13,000 back when he and Diana got married (1958 I think), it's paid for ...they raised all thier kids and grandkids in that house...they have memories attached to it that no amount of money can every repay...

I don't like Eminent Domain...Makes one think that nothing is every truly yours...Mike and I can buy a house, make it a home but you can never really truly feel safe in it cause at any moment the Suits could come and out you go...Somehow it really doesn't seem fair to anyone...

What is your opinion?????

I have one word to sum up what I think about it...revolution.

This is the end result of the courts being allowed to act on their own agendas, which they are not supposed to do.

This kind of break down isn't only in the courts, it's also everywhere in the goverment, especially the federal goverment.

Technically, we are not even supposed to have a federal goverment. All states are supposed to be able to take care of their own issues and problems. But those days have been gone for a very long time and until the system completely caves in on itself, things are not going to get any better. The way things are going, that massive collapse is just around the corner.

Excuse my bluntness, but even renters shouldn't live by a false sense of security as rental property can be taken and replaced with office buildings or a strip mall just as easy as private property.

Consider this and my weird way of thinking:

Rental property is income to somebody, in which they have to pay taxes on. Every year, renters are allowed to write off their rent and get part of it back.

So the goverment gains some, then loses some although they still make a killing with in interest they earn.

So really, a strip mall would be more of a money maker because a mall generates more revenue. Not only because it is a mall, but because it is an excuse to jack up property taxes to cover road repair, fire, police, ect... In the end, they make more money that way then from complexes that rent out to so many people.

Nobody is safe anymore as private property just became public property. The US is falling under the Communist rule...

Oh and I need to add that by imposing this really stupid rule, not only did the court shoot themselves in the foot, they also shot the banks and mortage companies too.

Why would anybody want to go out and purchase property, just like you mentioned with the threat of it being taken away?

I'm almost willing to bed a box of doughnuts that within the next 6-12 months there is going to be an onslaught of poor mouthing from banks because they're not making any money.

Okay, I'm done. The boy doesn't want to behave, so he has floors to wash. Just call me Adolf for now on as that is how I feel, minus the ugly mustache.

I know being a renter, the property can still be taken..but I always have the idea that the property is not really mine to begin with..I'd feel different if it was something I bought and paid for and own the deed....

My point was that anybody at any given time can be uprooted from their "home" regardless of what that home may be (apartment, condo, tent...whatever)because the court and goverment have decided that this is a perfect money maker.

Kind of like the Chinese making baby adoption a full blown business. It's not right, but they do it anyway for the sake of making easy money.

Like Stacy, I have strong feelings on this issue. We've lost land to Eminent domain ... a street next to our business was being widened and they took a major part of our parking lot for the construction.

The parking lot was diminished to almost half it's original size and we had to buy adjoining property and build a new building and parking lot for our business.

That was a case where the state used eminient domain for the public good. We did get fair market value for the parking lot and were able to build a better building and our business did not sufer.

That is the way this process is supposed to work.

But, if you'll look at how eminent domain has been used in the last 10-20 years, you'll see that the courts have continually revised how "public good" is defined ... and that's not good.

Originally, it could be used ONLY for public roads, parks and schools ... that kind of thing.

Now public good is can be defined as "tax base," which allows any business that enlarges the tax base can be seen as "public good." This means any business can seek to use eminent domain to gain any personal property.

That is just wrong. Wrong. Wrong. Wrong.

The US is moving toward socialism and I can't stand it ... hummph.
